Massage Establishment Requirements

Chapter 5.24 of the Huntington Beach Municipal Code (HBMC) governing the massage industry requires all massage establishments to apply for and maintain a valid Establishment Registration Certificate (ERC) issued by the Huntington Beach Police Department.

The issuance of an ERC ensures all establishments have registered with the Police Department and have also been made aware of the laws, duties, and requirements of owning or operating a massage establishment in the City of Huntington Beach.   A massage ERC is only valid for one year and must be renewed annually.  For additional information, please view HBMC 5.24 Massage Establishments.

HBMC 5.24.035(A)(2) requires new massage establishments to be no fewer than 1,000 feet from another massage establishment as measured from the property lines.  Please contact the Business License office at (714) 536-5267 to verify an address and to obtain an application for a massage ERC and business license.  Phone hours are from 8:30 a.m. to 4:00 p.m. Monday through Friday.  You may email inquiries to [email protected].

Incomplete or inaccurate applications will not be accepted/approved until corrected.  Additionally, if you currently owe any monies due to the City or are in violation of any chapter of the HBMC, your application will not be approved.  It is illegal to operate a massage establishment in the City of Huntington Beach without a current and valid massage ERC.

Please be aware that non-compliance of the Huntington Beach Municipal Code will result in the issuance of Administrative Citations with fines starting at $250 and ultimately placing the ability to conduct your business in the City of Huntington Beach in jeopardy.

Who needs to apply for an Establishment Registration Certificate (ERC)?
Any business located in the City of Huntington Beach that offers massage services to the public are required to obtain a massage ERC.
What happens if I am not in possession of a valid ERC?
It is illegal to operate a massage establishment or offer massage services in the City of Huntington Beach without a current and valid massage ERC.  Conducting massage services while not possessing a valid ERC renders your business as non-compliant with the HBMC and you will be issued citations and fines.  Additionally, it will affect your ability to conduct business in the City of Huntington Beach and will subject your business license to revocation.
What is the process to apply for an ERC?
The process includes verifying the proposed business location is not within 1,000 feet of another massage establishment by contacting the business license office, submitting the ERC application completely and accurately which includes all required additional documents, and paying the non-refundable application/processing fees.  Business owners/operators will also need to obtain a Certificate of Occupancy (C of O) from the Community Development Department and apply for a business license.
How long does it take to be issued a valid ERC?
The Huntington Beach Police Department has up to 60 days to approve or deny an ERC application from the date a completed and accurate application was received.  You will not be able to provide any massage services until the ERC has been issued to your business by the police department.
Am I required to apply and pay for an ERC every year?
Yes, the ERC is effective for one year and needs to be renewed annually by submitting a renewal application and payment no less than 60 days before the current ERC expiration date
Does an ERC take the place of my Business License?
No, the ERC does not take the place of your Business License. You will need to maintain both a valid ERC and a valid Business License.
